Family law is complex, and the rules vary from state to state. Here are a few key things to understand about Texas family law and how it may impact your case:
Texas is a community property state. This means that any assets or debts acquired during the marriage are presumed to be owned equally by both spouses and subject to division upon divorce. However, there are exceptions for separate property, such as property owned prior to marriage or inheritance. (Tex. Fam. Code § 7.001)
In a divorce, the court will divide the community estate in a “just and right” manner, taking into account various factors, including each spouse’s earning capacity, custody of children, and fault in the divorce.
In Texas, child custody is known as “conservatorship.” The court’s primary concern in determining conservatorship is the child’s best interests. There is a rebuttable presumption that joint managing conservatorship (similar to joint custody) is in the child’s best interests. (Tex. Fam. Code § 153.131)
However, if there is a history of family violence or abuse, the court will typically award sole managing conservatorship to the non-abusive parent.
Texas uses a formula to calculate guideline child support based on the non-custodial parent’s net resources and number of children. The court can deviate from guideline support for a variety of reasons, such as if the child has special needs or to account for the custody/visitation schedule.
